The controller processes the personal data of NS SMS API platform users in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

§2. Scope of data collected

As part of using the Service, we process the following personal data:

  • First and last name
  • E-mail address
  • Technical data (IP address, access logs, device information)
  • Payment transaction data (handled by Przelewy24)
  • Logs of sent SMS messages (recipient phone number, delivery status)

§3. Purposes and legal bases of processing

We process personal data for the following purposes:

  • Performance of a contract (Art. 6(1)(b) GDPR) — account registration, provision of services, payment handling
  • Legitimate interest (Art. 6(1)(f) GDPR) — system security, abuse detection, technical logs
  • Legal obligation (Art. 6(1)(c) GDPR) — retention of invoices and accounting records

§4. Data recipients

Data may be shared with the following entities:

  • DialCom24 Sp. z o.o. (Przelewy24) — payment handling
  • Hosting and cloud service providers
  • Public authorities — solely on the basis of applicable law

We do not sell personal data to third parties.

§5. Data retention period

We retain data for the following periods:

  • Account data — until the account is deleted by the user
  • SMS logs — 90 days
  • Invoice data — 5 years (required by tax regulations)
  • Technical logs — 30 days

You have the following rights regarding the protection of personal data:

  • The right of access (Art. 15 GDPR)
  • The right to rectification (Art. 16 GDPR)
  • The right to erasure (Art. 17 GDPR)
  • The right to restriction of processing (Art. 18 GDPR)
  • The right to data portability (Art. 20 GDPR)
  • The right to object (Art. 21 GDPR)
  • The right to lodge a complaint with the President of the Personal Data Protection Office (UODO)

§7. Cookies

The Service uses cookies that are essential for operating the user session and ensuring security (CSRF token). We do not use marketing or tracking cookies.

§8. Changes to the privacy policy

The controller reserves the right to amend this Privacy Policy. Users will be notified of any significant changes by e-mail. The current version of the Policy is always available at /polityka-prywatnosci.
